In Acafellas, Kurt, a sophomore, mentions that his dad gave him the Nav for his 16th birthday (date unspecified, but it had to have been within the school year). This episode takes place in September or early October.
Kurt is the youngest of his grade.
This means that everyone who is a Senior right now is 18.
This means that everyone who is a Junior right now is 17.
This means that as of episode 3.02, Kurt is 18 and Blaine is 17.
This means that in season 2, Kurt was 17 and Blaine was 16.
Ohio State’s age of consent law is thus:
2907.04 Unlawful sexual conduct with minor.
(A) No person who is eighteen years of age or older shall engage in sexual conduct with another, who is not the spouse of the offender, when the offender knows the other person is thirteen years of age or older but less than sixteen years of age, or the offender is reckless in that regard.
So even if Blaine was 16, it would still be legal for Kurt to have sex with him in 3.05. Now if Blaine was 15 and Kurt was 18, THEN it’d be illegal. But as we can see from evidence above, that is not the case.
